Terms of Use

1. General Provision

By using the alienbal.com website or its subdomains, features, content, mobile applications, or other services provided by Sole Proprietor Balakireva Ekaterina Georgievna (Tax ID: 503235067274) (hereinafter referred to as "Service", "Project", "AlienBal", "alienbal.com", "We", "Our", "Site"), whether as a Guest or a Registered User, you agree to comply with the following terms and conditions ("Terms of Use").

2. Our Relationship with the Customer

  • By accessing and using our products and services, you agree to abide by the terms of use set out here, as well as our "Privacy Policy".
  • If you decide that you no longer want to use our products and services, you can terminate your agreement at any time by deleting your profile in your personal account.
  • We commit to doing our best to provide you with quality services. In turn, you agree to refrain from actions that interfere with or prohibit us from providing you with these services.
  • If you are not satisfied with our services or feel that our Service did not meet your needs and expectations, we will gladly refund your project funds. However, if we have completed more than 30% of the project work, we reserve the right to deny a refund.
  • If you violate our "Terms of Use", we reserve the right to close your account or discontinue providing products and services.

3. Your Obligations

  • You must be at least 18 years old to use our Service.
  • You are responsible for the security of your account credentials. Your account is under your responsibility, so we recommend you to keep this information in a safe place.
  • Your account may only be used by one individual or legal entity (one account - one employee).
  • You may not use the Service for any illegal or unauthorized purposes. When using the Service, you must not violate any laws in your jurisdiction (including copyright and trademark laws).
  • We are not responsible for the decisions you make or for your actions that go beyond our products and services.
  • Our products and services are intended for your personal use. We make every effort to provide you with a quality product and service and expect that you will not attempt to resell, copy, or provide our products and services to others without our written permission.

4. Registration, Payment, and Refund

  • Payment requires a valid debit, credit card, or PayPal account. You also have the option to pay by other methods if such methods are available at the time of payment: cash, bank transfer to the company account according to the provided details.
  • Depending on the payment method you choose and your country in your profile settings, the price of the product/service will be transferred to the payment system, when paying through "Internet Acquiring from Tinkoff Cashier" the price of the product/service will be presented in rubles, when paying through the "Stripe" service, the price will be presented in USD/EUR currency for all countries except the Russian Federation. If you use VPN, proxy servers, the "TOR" browser, and other anonymization tools, you may encounter difficulties in payment. We recommend you to choose your country of residence in your profile settings.
  • The price of goods/services in other currencies presented on our website is indicative and may be changed by your chosen payment system either downwards or upwards. We are not responsible for any additional fees that the payment system may charge. The cost of each service is set in 3 main currencies (USD, EUR, RUB). The price for the service will be presented depending on the country chosen in your profile. The cost is formed according to the current rate each day and "frozen" at the time of order confirmation and processing until payment is made.
  • The service/product is paid for in advance and activated after receipt of funds.
  • If the product or service (subscription and other types of services) states that they are provided for a month or several months, a month means 30 calendar days. 1 year means 365 days.
  • Upon expiration of the paid service period, your account capabilities will be reduced. This may lead to the loss of content, features of our service. alienbal.com is not responsible for such losses.
  • A refund is possible within 14 days after the payment for the goods/service. To request a refund for a purchase or service, you must send a written request to support@alienbal.com. Refunds are made within 30 days of the request, but in some cases, a refund may be made within 90 days. Not all types of services provide for a refund.
  • If a user initiates a refund after purchasing a service or product, and then makes a purchase of a product or service again (products with a type of temporary subscription for access to the "AlienBal" service), the refund may be denied with subsequent blocking of the account at the discretion of the administration of the "AlienBal" website.

5. Deactivation and Cancellation of Account

  • You can delete your account (profile) at any time in your personal account in the profile settings.
  • alienbal.com, at its discretion, has the right to suspend or terminate your account and at any time refuse any current or future use of the Service or any other service.

6. Changes in Service and Prices

  • alienbal.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service/Product (or any part thereof) with or without notice.
  • alienbal.com is not responsible to you or any third party for any changes, price changes, suspension, or discontinuance of the service.

7. Promotions, Promo Codes, Bonuses, and Other Discount Programs

  • alienbal.com reserves the right to change or discontinue promotions and/or discounts at any time and from time to time with or without notice. If a promotion or discount ends, we will do our best to provide extended notice, but this is not guaranteed.
  • Promo codes, promotions may be changed or removed at any time without prior notice.
  • Bonuses may only be used to pay for certain types of subscriptions/products/services and materials presented on the site. The possibility of using bonuses will be reflected on the page of the product/service/subscription/material. Each service/product/material/subscription may have its own rule for the provision and deduction (number of units) of bonuses.
  • Bonus - 1 unit of conditional internal currency for services/subscriptions/products/materials for which payment by bonuses is possible.
  • Promotions, discounts, promo codes do not accumulate with each other.
  • Bonuses cannot be withdrawn or spent on services/products/subscriptions/materials that do not provide for this.
  • For attempts to pick (guess) in the promo code entry line, the account may be blocked.

8. Changes in Service and Prices

  • You may not duplicate, copy, publish, or reuse any part of the HTML or CSS, Javascript, visual design elements, educational materials, or partially copy/modify educational materials without the written permission of alienbal.com.
  • All information provided on the site is the property of alienbal.com and cannot be appropriated by anyone.

9. Design Expectations and Project Timeline Adjustment for the "Design Development" Service

  • We recognize that the design of your website or application may not immediately meet your expectations. This may occur because our designers might need time to fully understand your preferences. We highly value achieving a design that matches your vision and will work collaboratively with you to refine and adjust the design. It's important to maintain open and detailed communication about your preferences and feedback throughout the design phase to facilitate a more accurate realization of your vision.
  • Please note that if more than three design variants have been created, the project completion timeline may be adjusted. Such adjustment can be made at the discretion of AlienBal unilaterally. The need for multiple design iterations indicates a commitment to quality and satisfaction, which may require additional time to ensure the final product meets your standards and preferences. We will inform you promptly and clearly of any changes to the project schedule, ensuring transparency throughout the development process.

10. General Conditions

  • You use the service at your own risk. The service is provided on an "as is" and "as available" basis.
  • Technical support is provided only to users with an account with active paid services and is available via email, online chat, Telegram bot. General technical support is provided to everyone. General technical support includes site navigation, clarification of the availability of service/product/subscription/material, appointment scheduling, meeting coordination, data clarification, explanation of the provided service.
  • You understand that alienbal.com uses third-party providers and partners for hosting/server to provide the necessary hardware, software, networks, storage, and related technology required to run the Service.
  • You must not modify, adapt, or hack the Service or modify another website to falsely imply that it is associated with "AlienBal" services.
  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, use of the Service, or access to the Service without the express written permission of alienbal.com.
  • Verbal, physical, written, or other abuse (including threats of abuse or retribution) of any customer, employee, member, or officer of alienbal.com will result in immediate account termination.
  • If your bandwidth usage significantly exceeds the average usage (as determined solely by "AlienBal" or our service providers), we reserve the right to immediately disable your account or throttle your usage until you can reduce your bandwidth consumption.
  • "AlienBal" does not warrant that (1) the service will meet your specific requirements, (2) the service will be uninterrupted, timely, secure, or error-free, (3) the results that may be obtained from the use of the service (4) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (5) any errors in the service will be corrected.
  • You expressly understand and agree that "AlienBal" shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if "AlienBal" has been advised of the possibility of such damages), resulting from: (1) the use or the inability to use the service; (2) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the service; (3) unauthorized access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the service; (5) or any other matter relating to the service.
